1. Introduction
These General Terms and Conditions of Sale apply to all sales made on the https://speciallabmotorcycle.com/gb/ website.
Special Lab Motorcycle is a brand of Special Lab di De Marco Gian Luca, by convention Special Lab Motorcycle will be called SLM.
The General Terms and Conditions of Sale may be changed at any time.
Any changes and/or new conditions will be in force from the moment they are published in the "Terms of Sale" section in the header and "Terms of Delivery and Payment" section in the footer of the Site. For this reason, users are invited to regularly access the Site and check the publication of the most up-to-date General Terms and Conditions of Sale.
The General Terms and Conditions of Sale applicable are those in force on the date the purchase order is sent.
In order to make purchases, it is not necessary to register on the Site, but it is necessary to approve, by checking the appropriate box in the shopping cart form at the time of purchase, these General Terms and Conditions of Sale. Failure to accept the General Terms and Conditions of Sale will make it impossible to make purchases.
SLM reserves, in any case, the right not to accept orders, from whomever they come from, that are anomalous in relation to the data entered or to the fact that they have other pending and unpaid orders. The purchase of items online entails the assumption of a commitment between buyer and seller as established by Legislative Decree No. 185 of 22/05/1999, which regulates the matter of distance contracts, i.e., made outside of business premises. Orders placed must be paid in full within 3 working days from the date of purchase (for advance payments), otherwise the order shall be cancelled.
2. Availability of articles
Customer orders are fulfilled within the limits of the quantity of products available. In the event that the product ordered is not available, SLM undertakes to contact the customer by e-mail within 10 days from the date of the order to inform him of the time required for delivery of the product ordered.
In the event that only some of the products ordered are not available, the order will be dispatched to the customer as soon as the availability of all products is satisfied. SLM undertakes to notify and keep the customer informed of the progress of the order.
The availability indicated on the Site is indicative and in no case represents a contractual obligation. Should SLM be forced for any reason to cancel an order, it will not be held liable for any damages.
3. Payments
SLM makes the following payment methods available to its customers:
- Bank transfer (no additional costs)
- PayPal (no additional costs)
- Credit card (no additional costs)
To pay by credit card, simply click on the "pay now" button on the order summary page and then click "Don't have a PayPal account?"
Cash on Delivery (Only for orders with shipment in Italy): approximately 7.00 euro up to a value of 516.46 euro, prices are increased by 1.4% on excess. For orders with shipment to countries outside Italy, it is not possible to pay cash on delivery but only by Paypal, PostePay, Credit Card or Bank Transfer. In the event that an order with shipment to a country outside the Italian territory is received, SLM will contact the customer by e-mail to propose an alternative method of payment or otherwise the order will be cancelled.
Possibility of collecting the goods at our premises (by appointment).
Information and payment details will be sent automatically to the e-mail address indicated by the customer when the order is taken.
In the event that the customer chooses to make payment by one of the methods of payment in advance, the goods will only be shipped after the amount due has been credited.
4. Invoicing
SLM's sales system, as an online seller, does not require an invoice to be issued to a private individual (not holder of a VAT number), according to Article 22 of Presidential Decree No. 633 of 26/10/1972 and Article 2, letter oo) of Presidential Decree No. 696 of 21 December 1996.
If you still wish to request an invoice, please enter your request in the notes at the end of the order. The invoice will be made out to the holder of the order and it will not be possible to make the invoice out to a different name or address. The invoice must be requested at the time of purchase on the portal by entering the request in the order notes.
5. Executing an order
Orders can be placed via the Internet at https://speciallabmotorcycle.com/gb/ 24 hours a day, 7 days a week.
If an order is placed on Friday, it will be taken on the following Monday.
Upon validation of the order, an e-mail will be sent to customers to confirm acceptance of the order with a summary of the payment method chosen and the relevant data.
6. About photos and descriptions
Photographs presenting the products are not part of the contractual scope and may under no circumstances be regarded as the responsibility of SLM. Technical data sheets and product descriptions are provided by SLM's partners and/or suppliers, and SLM accepts no liability for their content.
7. Prices
The sales prices shown on the Site are in euros and include VAT.
SLM reserves the right to change prices at any time, but is equally committed to applying the prices indicated on the website at the time the order is placed.
In the event that articles are sold for which sales prices are manifestly incorrect or lower than the actual sales value, SLM reserves the right to cancel the order.
8. Delivery methods and costs
Products purchased on the site can be delivered throughout Italy, including the islands, and to all countries belonging to the European Community.
Delivery costs in Italy are €9.50, except for fairings for which there is a charge of €19.00 and are invoiced at the end of the order as a supplement to the products selected. For the shipment of items outside Italy, the shipping cost will be calculated at the time the order is placed, as the cost varies depending on the geographical area.
- Cash on delivery: dispatch will take place within 24/48 hours of receipt of the order and in any case no later than the time specified on the product
- PayPal: shipment will take place after confirmation of payment in 24/48 and in any case no later than the time specified on the product
- Bank transfer: Shipment will take place after bank confirmation of payment in 24/48 hours and in any case no later than the time indicated on the product
- Credit Card: shipment will take place after confirmation of payment in 24/48 hours and in any case no later than the time indicated on the product.
SLM usually uses SDA services for its shipments, but reserves the right to send orders, at its own discretion, with any other shipping company. SLM undertakes to inform the customer of the shipment by e-mail.
The delivery time varies from 1 to 30 working days. Delivery times indicated on our website are approximate and are subject to change.
We would also like to remind customers that couriers only transport and deliver products on weekdays (e.g. for a product ordered on a Friday evening, you will have to count the days from Monday morning if the product is available). SLM cannot be held liable for the consequences of any delay in delivery. In the event of loss or damage of the order by the courier, if the customer has not chosen to insure his or her shipment, in no case can SLM be held liable.
8.1 What to do at the time of delivery:
- Check that the parcel is in good condition.
- Open the package in the presence of the courier and politely ask him to wait for verification.
- Check that the product is as ordered and that there is no damage or apparent anomaly. If no problems are found, accept the delivery.
- In case of non-conformity or apparent damage, refuse the delivery and fill in the acceptance form indicating the problem encountered. Then return the package to the courier and send an e-mail to Customer Service at infospeciallab@gmail.com describing the incident within the next 48 hours, stating your full name and order number.
In the event that the products have to be returned by the customers, the latter shall return them within 48 hours from the date of delivery by sending them to the following address:

The products must be returned in their original packaging, including manuals and any other accessories that may be present in the package received.
The costs of returning the product are reimbursed by SLM to customers in the case of defective products. In other cases, the return shipping costs remain the responsibility of the customers. The reimbursable shipping costs may not, under any circumstances, exceed the shipping costs that SLM charges on its website.
8.2 Delivery failed:
For absent addressee:
SLM endeavours to keep the customer informed of the status of his shipment so as to be ready at the time of delivery.
The courier will attempt delivery a first time, if it is unsuccessful on the first attempt due to an absent addressee, he will leave a notice in the letterbox and attempt again the next day. If the second attempt is also unsuccessful, the consignment goes into storage. The courier will then open the storage file and inform us of the incident. We will contact the customer and ask for instructions. For the return of the shipment, the customer will be charged a flat rate of EUR 10 incl. VAT for the instruction of storage, parcel storage and return.
These costs are to be paid in one of the advance methods no later than 3 days after the customer has been notified by e-mail. In any case before the package is returned. Otherwise the shipment will be returned to our premises. At this point we will refund the returned items net of the costs incurred for round-trip shipping, storage and parcel docking.
For incorrect or incomplete address:
The courier will attempt delivery one first time, if it fails to do so due to an incorrect or incomplete address, the shipment will go into storage. We will contact the customer and ask for instructions. At this point, EUR 10 will be requested and charged for re-delivery of the shipment. These costs must be paid in one of the prepaid methods no later than 3 days after notification by email. In any case before the package is returned. Otherwise the shipment will be returned to our premises. At this point, we will refund the returned items net of the costs incurred for return postage, storage and parcel storage.
8.3 Unsuccessful delivery for Cash on Delivery Rejected:
Rejecting a marker is a very serious matter!
In the case of cash on delivery, the purchaser undertakes to pay on delivery and under no circumstances may he refuse the shipment (unless there are problems with the integrity of the package See point "What to do on delivery" ). Only after collecting the goods may the customer enjoy the right of withdrawal in the manner indicated in the previous point.
If the addressee rejects the goods, e.g. because he is no longer interested, he will be charged the cost of return postage in the amount of EUR 20 in addition to any storage costs of EUR 1.50 + VAT per day. In addition, a flat-rate cost of EUR 7 + VAT will be charged for storage instruction costs.
In the event that the customer refuses to proceed to compensation in accordance with these terms and conditions or is not available or does not respond to our communications, the procedure will be passed on to our lawyer who will recover the debt by legal means, with an obvious increase in costs for you. The possibility of assigning the debt to a debt collection company will also be considered.
9. Right of Withdrawal
The user who has purchased products via the Site has the right to withdraw from the contract concluded with SLM, without any penalty and without specifying the reason, within ten (14) working days from the date of receipt of the goods. Please note that Saturdays are not considered working days.
This right is reserved exclusively for natural persons (consumers), so it cannot be exercised by legal persons and natural persons acting for purposes related to their professional activity, if any.
9.1 How to Make a Return
- send an e-mail to ordini@speciallabmotorcycle.com stating that you wish to make a return, including the order number of the goods to be returned;
- notice of withdrawal may be sent within a period of (14) days from the date of receipt of the goods;
- print and fill in the form returned tothis link, click on Download Standard Withdrawal Form;
- pack well the item to be returned complete with all packaging, instructions, screws and anything else received with the item, and of course the completed return form.

- once we have received the return and ascertained the condition, we will refund within 10 working days or exchange the goods if the object of the return is an exchange.
The cost of returning the product shall be borne entirely by the customer. The right of withdrawal lapses completely if the returned product is not intact, i.e:
- lack of original packaging
- absence of product components (accessories, screws, instruction manuals, etc.)
- presence on the product of signs of wear or use
- for alectronic accessories please test the instrument on the bench before installation
- we do not accept returns of electronic accessories with shortened wires or modified wiring harnesses
SLM will proceed with the transmission of the order to re-credit the cost of the goods shipped within 10 working days from receipt of the return, and in any case not before receipt of the goods, in the case of returns due to second thoughts or other reasons not covered by the guarantee, the transport costs will not be reimbursed, in the case of an order with free shipping costs, a lump sum of €7.00 will be deducted from the reimbursement as shipping costs incurred in sending the order.
SLM will accordingly reject any product returned unpacked, as well as products for which the return costs have not already been paid in full by the Customer.
Refunds will not be allowed for customised items produced at the customer's specific request.
10. Disputes and Liability
These General Conditions are governed by the laws of Italy. SLM cannot be held liable in the event of non completion of the contract due to force majeure, total or partial disruption or strikes of the public or private postal services and/or the couriers used, floods, fires and/or wars. Furthermore, SLM cannot be held liable for any indirect damages, financial and/or economic losses and expenses that may be caused by the purchase of a product on the Site.
SLM cannot be held liable for the consequences resulting from improper use of the products sold on the site, including non-approved products, for which the law allows only and exclusively a collector's use or in dedicated areas.
Any manufacturing defects must be notified by the customer within 10 working days of receipt and cannot in any way hold SLM liable for any damage to persons or property. The total impossibility of using the ordered products, in particular due to material incompatibility, cannot be grounds for reimbursement or compensation or hold SLM liable. Web links on the Website may redirect customers to external websites. SLM is not responsible for the content of those sites, even if they do not comply with the legal and regulatory provisions in force.
Although some of the products sold on our site are compatible with professional use, SLM cannot be held liable for damages resulting from professional use of these products.
Where SLM's liability can be proved, it shall always be limited to the value of the order.
11. Personal Data Protection
The information requested by SLM from Customers is indispensable for the processing and validation of orders, the issuing of invoices and guarantee contracts. The absence of this information results in the automatic cancellation of the order. Registration on the Site implies the obligation to provide true and sincere personal information. The provision of false information is contrary to the provisions of the present General Terms and Conditions and the Terms of Use of the Site.
Customers have a permanent right to access and modify their personal data, as provided for by the Italian and European laws currently in force. Customers can send a request to SLM at any time to check exactly what and how much personal data has been stored (access is strictly limited to their own personal data). One's own data can be modified upon simple request.
SLM is the only company that holds the personal data of its customers. Only SLM and its partner companies are authorised to send promotional e-mails to customers and only in the context of clearly defined business operations.
SLM's partners were chosen for the quality of their products and services and their professionalism.
